By accessing or using WellCheck365, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
2. Description of Service
WellCheck365 provides automated daily wellness check-in services via SMS text messages and phone calls. The service sends daily check-in messages to your designated contacts and alerts you if they do not respond or request assistance.
3. Subscription and Billing
WellCheck365 offers tiered subscription plans based on the number of contacts:
- Starter: Up to 6 contacts - $6.99/month
- Standard: Up to 12 contacts - $12.99/month
- Premium: Up to 50 contacts - $29.99/month
Automatic Plan Upgrades: If you add more contacts than your current plan allows, your subscription will be automatically upgraded to the appropriate tier. You will be charged the new rate on your next billing cycle. By adding contacts that exceed your current plan limits, you consent to this automatic upgrade.
Subscriptions are billed monthly. You may cancel your subscription at any time from your dashboard settings. Cancellation takes effect at the end of your current billing period.
4. User Responsibilities
You agree to:
- Provide accurate contact information for yourself and your contacts
- Obtain consent from individuals before adding them as wellness check recipients
- Respond promptly to alerts about missed check-ins
- Keep your account information up to date
- Not use the service for any unlawful purpose
5. Consent of Check-In Recipients
Before adding any contact to receive wellness check-ins, you must obtain their explicit consent. When a contact is first added, they will receive a message asking them to confirm their participation. Contacts may opt out at any time by responding to any check-in message.
6. Limitations of Service
WellCheck365 is a wellness check-in service, not a medical monitoring or emergency response service. While we provide alerts when contacts do not respond, we are not a substitute for:
- Medical monitoring devices or services
- Emergency response systems
- Professional caregiving or medical care
In case of a medical emergency, always contact emergency services (911) directly.
7. Service Availability
We strive to maintain reliable service but cannot guarantee uninterrupted availability. Service may be affected by telecommunications outages, maintenance, or other factors beyond our control. We are not liable for any damages resulting from service interruptions.
8. Limitation of Liability
WellCheck365 and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
9. Changes to Terms
We may update these terms from time to time. We will notify you of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the new terms.
10. Termination
We may terminate or suspend your account at any time for violation of these terms. You may terminate your account at any time by canceling your subscription from your dashboard settings.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
